By registering and using the App, you accept these Terms of Service.

2. Description of Service

Comicself is an app that:

• Transforms diary entries into personalized comic strips
• Enables avatar creation based on selfies or descriptions
• Offers various comic styles
• Includes a gamification system with experience points (EP)
• Offers print-on-demand for comic booklets

3. Registration and Account

3.1 Requirements

• Minimum age: 16 years (under 16 with parental consent)
• Valid email address
• Agreement to these Terms of Service and Privacy Policy

3.2 Account Responsibility

• You are responsible for the security of your credentials
• You may not share your account with third parties
• Notify us immediately if you suspect unauthorized access

4. Free and Paid Features

4.1 Free Version

• 3 comics per week
• 2 comic styles (Minimal, Cartoon)
• Basic features

4.2 Digital Pro (EUR4.99/month)

• Unlimited comic creation
• All 6 comic styles
• Priority generation
• Photo references
• Character management

4.3 Print Subscription (EUR14.99/month)

• All Digital Pro features
• 1 printed comic booklet per month
• Free worldwide shipping

4.4 Payment Terms

• Subscriptions renew automatically
• Cancellation possible at any time (effective at end of period)
• No refunds for already paid periods
• In-App Purchases through Apple are subject to Apple's terms

5. Usage Rights and Restrictions

5.1 Your Rights

• You retain all rights to your diary entries
• You receive a non-exclusive license to use generated comics for personal purposes

5.2 Our Rights

• We reserve the right to modify or discontinue the App at any time
• We may use anonymized data for analytics purposes

5.3 Prohibited:

• Use for illegal purposes
• Uploading unlawful, offensive, or pornographic content
• Attempting to hack or manipulate the App
• Automated access or scraping
• Resale or commercial use without permission
• Circumvention of usage restrictions

6. Intellectual Property

6.1 Our Content

• The App, its design, and all trademarks are our intellectual property
• Comic styles and algorithms are copyrighted

6.2 AI-Generated Content

• Comics are generated by AI (OpenAI)
• You receive usage rights for personal and non-commercial purposes
• For commercial use, contact us

7. Liability

7.1 Limitation of Liability

• We are only liable for intent and gross negligence
• Liability for slight negligence is limited to foreseeable damages
• We are not liable for damages caused by force majeure or third parties

7.2 Availability

• We strive for high availability but do not guarantee it
• Maintenance may cause temporary restrictions

7.3 AI-Generated Content

• We do not guarantee any specific quality of generated comics
• AI results may vary and be unpredictable

8. Termination

8.1 By You

• You can delete your account at any time in Settings
• For paid subscriptions: Cancel through Apple or Stripe

8.2 By Us

• We may suspend or delete accounts for violations of these terms
• For serious violations, without warning

9. Privacy

Processing of personal data is governed by our Privacy Policy.

10. Changes

• We may change these terms at any time
• Material changes will be communicated via email or in-app notification
• If you do not accept changes, you may delete your account

11. Final Provisions

11.1 Applicable Law

European Union and Portuguese law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

11.2 Jurisdiction

For consumers, the statutory jurisdiction applies. For businesses, the jurisdiction is Lisbon, Portugal.

11.3 Severability Clause

If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
