End User License Agreement (EULA)

Licensed Application: Comicself

Effective: January 2026

PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE CLICKING "ACCEPT".

This End User License Agreement ("EULA") is a legal agreement between you ("End User" or "You") and Lenny David Enderle ("Provider", "we" or "us") regarding your use of the Comicself application ("Licensed Application" or "App").

1. Acknowledgement

This EULA is concluded solely between You and the Provider, not with Apple Inc. ("Apple"). The Provider, not Apple, is solely responsible for the Licensed Application and its content.

2. Scope of License

2.1 License Grant

The Provider grants you a revocable, non-exclusive, non-transferable, limited license to install and use the Licensed Application on Apple-branded devices that you own or control, in accordance with the Usage Rules in the Apple Media Services Terms.

2.2 Usage Restrictions

You may not:

Copy, modify, or create derivative works of the App
Sell, license, rent, or transfer the App
Reverse-engineer, decompile, or disassemble the App
Circumvent or disable security features

3. Consent to Data Use

You agree that the Provider may collect and use technical and related information-including but not limited to technical information about your device, system and application software, and peripherals-that is gathered periodically to facilitate the provision of software updates, product support, and other services (if any) related to the Licensed Application.

4. Subscriptions and In-App Purchases

4.1 Available Subscriptions

Digital Pro: EUR4.99/month - Unlimited comics, all styles, priority generation
Print Subscription: EUR14.99/month - Includes Digital Pro + monthly printed booklet

4.2 Payment Processing

In-App Purchases are processed through your Apple Account
Print Subscription is processed through Stripe (external payment system)

4.3 Automatic Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
Cancel via: Settings > [Your Name] > Subscriptions on your Apple device

4.4 No Refunds

All purchases are final. Refunds are subject to Apple's policies or the respective payment provider's policies.

5. Maintenance and Support

5.1 Support Obligation

The Provider is solely responsible for providing maintenance and support services for the Licensed Application, as specified in this EULA or as otherwise required by applicable law.

5.2 Apple Has No Support Obligation

Apple has no obligation whatsoever to provide maintenance or support services for the Licensed Application.

6. Warranty

6.1 No Warranty by Apple

Apple provides no warranty for the Licensed Application.

6.2 Warranty by Provider

The Licensed Application is provided "as is". The Provider disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.3 Refund for Non-Conformance

If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Licensed Application.

7. Product Claims

The Provider, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:

Product liability claims
Claims of failure to meet legal requirements
Consumer protection claims

8. Intellectual Property Rights

8.1 Infringement Claims

The Provider, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes any third party's intellectual property rights.

8.2 Ownership

Intellectual property in the App remains with the Provider. You acquire no ownership rights in the App.

9. Legal Compliance

You represent and warrant that:

You are not located in a country subject to a U.S. Government embargo
You are not located in a country designated by the U.S. Government as a "terrorist supporting" country
You are not listed on any U.S. Government list of prohibited or restricted parties

11. Third-Party Beneficiaries

11.1 Apple as Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of the terms of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

12. Termination

12.1 Termination by You

You may terminate this license at any time by deleting the App and all copies.

12.2 Termination by Provider

This license terminates automatically if you violate any of its terms.

12.3 Effect of Termination

Upon termination, you must cease all use of the App and delete all copies.

13. Governing Law

This EULA is governed by European Union and Portuguese law, without regard to conflict of law provisions. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.

14. Severability

If any provision of this EULA is found invalid or unenforceable, the remainder of this EULA remains in full force and effect.

By using the App, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms.
